Welcome to VGC Dojo. By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms, you may not access or use VGC Dojo.

These Terms constitute a legally binding agreement between you and VGC Dojo. Please read them carefully.

VGC Dojo is an independent, fan-made educational platform designed to help users improve their understanding of competitive Pokémon strategy through interactive training exercises, puzzles, and educational content.

VGC Dojo is NOT a Pokémon game, battle simulator, or substitute for official Pokémon products. Users cannot battle Pokémon against each other or against AI opponents. We do not replicate, emulate, or provide any gameplay that competes with or replaces official Pokémon products.

Our platform functions as a study tool—similar to chess puzzles or sports film study—offering educational exercises that help players think through competitive scenarios and learn strategic concepts. All gamified elements exist solely to make learning more engaging, not to recreate Pokémon battling.

By accessing VGC Dojo, you represent and warrant that:

• You are at least 13 years of age, or if under 13, you have obtained verifiable parental consent to use this platform
• You have the legal capacity to enter into these Terms
• You will comply with all applicable local, state, national, and international laws and regulations
• You have read and understood these Terms in their entirety

If you are a parent or guardian agreeing to these Terms on behalf of a minor, you accept full responsibility for that minor's use of VGC Dojo and agree to be bound by these Terms.

Subject to your compliance with these Terms, VGC Dojo grants you a limited, non-exclusive, non-transferable, revocable license to access and use the platform for your personal, non-commercial educational purposes only.

This license does NOT include the right to:

• Sell, resell, license, or commercially exploit any aspect of the platform
• Modify, adapt, or create derivative works based on the platform
• Reverse engineer, decompile, or disassemble any software components
• Use the platform for any purpose other than personal educational improvement

4.1 Third-Party Trademarks

Pokémon and all related names, characters, and imagery are trademarks and copyrights of Nintendo, The Pokémon Company, Game Freak, and Creatures Inc. VGC Dojo is not affiliated with, endorsed by, sponsored by, or specifically approved by any of these entities. Any reference to Pokémon species, moves, abilities, or game mechanics is made for purposes of commentary, education, and analysis of competitive play strategies under principles of fair use.

4.2 VGC Dojo Original Content

All original content created by VGC Dojo—including but not limited to training scenarios, battle puzzles, team selection problems, speedometer exercises, matchmaker profiles, strategic explanations, educational feedback, user interface design, and pedagogical methodology (collectively, "Platform Content")—constitutes proprietary intellectual property owned exclusively by VGC Dojo.

The Platform Content represents substantial creative investment including original scenario design, strategic analysis, pedagogical methodology, and curated educational content that is protected under applicable intellectual property laws including copyright, trade secret, and database protection laws.

4.3 Ownership Reservation

VGC Dojo reserves all rights not expressly granted in these Terms. Nothing in these Terms transfers any ownership interest in the Platform Content to you or any third party.

You agree that you will NOT:

• Data Extraction: Scrape, crawl, spider, harvest, or use any automated means (including bots, scripts, or AI tools) to access, extract, copy, or index any Platform Content
• Reproduction: Copy, reproduce, republish, upload, post, transmit, distribute, or publicly display any Platform Content in any form or medium
• Derivative Works: Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on Platform Content
• Commercial Use: Use any Platform Content for commercial purposes, including in competing products, services, applications, or educational platforms
• Circumvention: Attempt to circumvent, disable, or interfere with any security features or access restrictions of the platform
• Misrepresentation: Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
• Interference: Interfere with or disrupt the platform, servers, or networks connected to the platform
• Notice Removal: Remove, alter, or obscure any copyright, trademark, or other proprietary notices from any Platform Content

The Platform Content represents significant creative and intellectual investment. VGC Dojo takes protection of this content seriously.

6.1 Independent Creation Requirement

Any person or entity developing, operating, or distributing a competitive educational platform, training tool, application, or similar product related to competitive Pokémon ("Competitive Product") must ensure that all content is independently created and original.

6.2 Demonstration of Originality

Upon written request by VGC Dojo, operators of any Competitive Product must be able to demonstrate:

• All puzzles, scenarios, problems, and educational content are independently created and original
• No content was derived from, based upon, or substantially similar to VGC Dojo's Platform Content
• No automated scraping, copying, extraction, or systematic access of VGC Dojo content was performed
• Documentation of the independent creative process exists and can be produced

6.3 Substantial Similarity

VGC Dojo reserves the right to pursue all available legal remedies against any Competitive Product that contains scenarios, puzzles, or educational content demonstrating substantial similarity to VGC Dojo's Platform Content, absent clear evidence of independent creation.

By submitting any content to VGC Dojo—including but not limited to bug reports, feedback, suggestions, puzzle ideas, scenario concepts, or other materials ("User Submissions")—you:

• Grant VGC Dojo a perpetual, irrevocable, royalty-free, worldwide, sublicensable license to use, modify, adapt, publish, translate, create derivative works from, distribute, and display your User Submissions in any media
• Represent that you own or have the necessary rights to grant this license
• Acknowledge that you will not receive compensation or attribution for User Submissions
• Understand that VGC Dojo may use, modify, or decline to use any User Submission at its sole discretion

Do not submit content you do not have the right to share or that contains confidential, proprietary, or sensitive information.

VGC DOJO IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, VGC Dojo disclaims all warranties, express or implied, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Any warranty that the platform will be uninterrupted, timely, secure, or error-free
• Any warranty regarding the accuracy, reliability, or completeness of any content
• Any warranty that the platform will meet your specific requirements or expectations

VGC Dojo does not guarantee any specific improvement in competitive Pokémon performance. Educational outcomes depend on individual effort, practice, and application.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• VGC Dojo shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses
• VGC Dojo's total cumulative liability for all claims arising from or related to these Terms or the platform shall not exceed the greater of (a) the amount you paid to VGC Dojo in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100)
• These limitations apply regardless of the theory of liability and even if VGC Dojo has been advised of the possibility of such damages

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless VGC Dojo and its owners, operators, affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use or misuse of the platform
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Submissions

VGC Dojo respects the intellectual property rights of others. If you believe that any content on VGC Dojo infringes your copyright, please submit a written notification containing:

• A physical or electronic signature of the copyright owner or authorized agent
• Identification of the copyrighted work claimed to be infringed
• Identification of the allegedly infringing material and its location
• Your contact information (address, telephone number, and email)
• A statement that you have a good faith belief the use is not authorized
• A statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner

VGC Dojo respects your privacy. Our current data practices:

• We do not currently require user accounts or collect personal information for basic platform use
• Progress data (such as streak counts) is stored locally on your device using browser storage
• We do not sell, rent, or share personal information with third parties for marketing purposes
• Standard web server logs may collect anonymous usage data (IP addresses, browser type, access times) for security and analytics purposes

If we implement user accounts or additional data collection in the future, we will update these Terms and provide appropriate notice.

If you are located in the European Union or other jurisdictions with data protection laws, you may have additional rights regarding your personal data. Contact us at vgcdojo@proton.me for privacy-related inquiries.

VGC Dojo does not knowingly collect personal information from children under 13 years of age. If you are under 13, please do not provide any personal information to us. If we learn that we have collected personal information from a child under 13, we will take steps to delete that information promptly.

If you are a parent or guardian and believe your child has provided personal information to VGC Dojo, please contact us at vgcdojo@proton.me.

VGC Dojo reserves the right, in its sole discretion, to:

• Terminate or suspend your access to the platform at any time, for any reason or no reason, with or without notice
• Remove or disable access to any content or functionality
• Discontinue the platform entirely

Upon termination, all licenses and rights granted to you under these Terms will immediately cease. Sections 4-11 (Intellectual Property, Prohibited Conduct, Competitive Products, User Submissions, Disclaimer, Limitation of Liability, and Indemnification) shall survive any termination.

VGC Dojo reserves the right to modify these Terms at any time. We will indicate the date of the most recent revision at the top of this page. Your continued use of the platform after any changes constitutes your acceptance of the revised Terms.

For material changes, we will make reasonable efforts to provide notice (such as a prominent notice on the platform). We encourage you to review these Terms periodically.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the platform shall be resolved through:

• Informal Resolution: You agree to first attempt to resolve any dispute informally by contacting us at vgcdojo@proton.me
• Jurisdiction: If informal resolution is unsuccessful, you agree to submit to the personal jurisdiction of the federal and state courts located in the United States for any actions for which you or we retain the right to seek injunctive or equitable relief

Entire Agreement: These Terms constitute the entire agreement between you and VGC Dojo regarding the platform and supersede all prior agreements.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver: No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

Assignment: You may not assign or transfer these Terms without VGC Dojo's prior written consent. VGC Dojo may assign these Terms without restriction.

No Agency: Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and VGC Dojo.

VGC Dojo exists to celebrate and support the competitive Pokémon community. We are fans first, and our goal is to help players develop the skills and knowledge to more fully enjoy official Pokémon games and competitions.

We believe that helping players become more skilled and engaged competitors strengthens the Pokémon community and supports the official VGC ecosystem that Nintendo and The Pokémon Company have built.

We encourage all users to purchase and play official Pokémon games and to participate in official Play! Pokémon events.
